    What Is Notarization — And When Is It Actually Required?

    What Notarization Actually Means — Not What Most People Think

    When a notary public notarizes a document, they are not verifying that its content is true or legally valid. They are certifying one specific, limited thing: that the person who signed the document appeared before them, presented identification, appeared to sign voluntarily and with apparent competence, and signed at that time.

    This is important because notarization does not make a document legally valid — an illegal contract remains illegal after notarization. Notarization also does not mean the notary reviewed the document for legal sufficiency.

    Documents That Commonly Require Notarization

    Real estate deeds and mortgage documents almost universally require notarization before recording. Powers of attorney — especially durable and healthcare powers — require notarization in most states, and some states additionally require witnesses. Wills require witnesses (usually two) but notarization requirements vary by state.

    Affidavits submitted in court proceedings require notarization. Vehicle title transfers require notarization in some states. Certain business documents — Articles of Organization, business agreements — may require notarization depending on the state.

    Documents That Don’t Require Notarization (Despite What Some Think)

    Most contracts between private parties don’t legally require notarization — a signed written contract is generally enforceable without a notary. Employment contracts, vendor agreements, non-disclosure agreements, and most business agreements are valid when signed by the parties, period.

    Notarizing these documents may add a layer of authentication evidence (proving the signature is genuine), but it’s rarely a legal requirement.

    Remote Online Notarization (RON) — The Pandemic-Era Change

    Many states now permit Remote Online Notarization — a video conference-based process where the notary verifies your identity digitally and witnesses your electronic signature. During COVID-19 pandemic restrictions, RON adoption accelerated dramatically, and most states that permitted it have made it permanent.

    Services like Notarize.com, DocuSign Notary, and PandaDoc Notary provide RON services. Not all documents can use RON — some states restrict it for real estate recordings or court filings.

    Finding a Notary Quickly

    Notaries are widely available: banks (often free for customers), UPS Stores and shipping centers, public libraries, law offices, real estate offices, and mobile notary services who come to you. The National Notary Association’s directory at nationalnotary.org helps locate notaries near you.

    Fees are typically $5–$15 per notarized signature, though banks often provide free notarization to account holders. Mobile notaries charge more due to travel — typically $50–$150 for a home or office visit.
